Terms of Service for Scibilis

Welcome to Scibilis. These Terms of Service ("Terms") govern your access to and use of Scibilis, an audio and video transcription service. By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.
1. Account Registration
To use certain features of Scibilis, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Acceptable Use
You agree not to use the service to:
- Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Infringe upon any intellectual property rights or other proprietary rights of any party
- Upload content that contains viruses, malware, or other harmful code
- Attempt to gain unauthorized access to any portion of the service or any other systems or networks connected to the service
- Interfere with or disrupt the service or servers or networks connected to the service
- Use the service for any illegal purpose or in violation of any local, state, national, or international law
- Process content without proper authorization or legal basis, including recordings of conversations without consent where required by law
3. Service Description
Scibilis provides AI-powered transcription services for audio and video files. The accuracy of transcriptions may vary based on audio quality, speaker clarity, background noise, and other factors. We do not guarantee 100% accuracy and you are responsible for reviewing and verifying all transcriptions before use.
4. Credits and Payments
Scibilis operates on a credit-based system. Credits can be purchased through our platform using Mollie as our payment processor. All payments are processed securely through Mollie and are subject to their terms of service.
Credits are non-refundable except where required by law. Unused credits remain in your account indefinitely unless otherwise stated. We reserve the right to modify pricing, credit allocations, and payment terms at any time.
Subscription plans, if offered, will automatically renew unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings.
5. Intellectual Property
You retain all rights to the content you upload to Scibilis. By uploading content, you grant us a limited license to process, store, and transcribe your content solely for the purpose of providing the service to you.
The Scibilis service, including all software, designs, logos, and content provided by us, is owned by Scibilis and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without our prior written consent.
6. Data Storage and Deletion
We store your uploaded files and transcriptions to provide the service. You can delete your content at any time through the platform. Upon account deletion, we will delete your personal data and content in accordance with our Privacy Policy and applicable laws, except where we are required to retain data for legal or regulatory purposes.
7. Third-Party Services
Scibilis uses third-party services including Mistral AI for transcription processing and Mollie for payment processing. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE TRANSCRIPTIONS WILL BE ACCURATE OR RELIABLE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCIBILIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
10. Indemnification
You agree to indemnify and hold harmless Scibilis and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and the jurisdiction in which Scibilis is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the effective date. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
